01 — Using Housing Perks

Website, web application and mobile app use

Definitions and introduction

App means the Housing Perks website, web application and mobile app. Company means Rainly Ltd, company number 14525292.

These terms apply between you, the user of this App (including sub-domains unless expressly excluded), and Housing Perks and Rainly Ltd of Everdene House, Deansleigh Road, Bournemouth, England, BH7 7DU, the owner and operator of the App. Please read them carefully, as they affect your legal rights. Your agreement to be bound by them occurs upon your first use.

    Intellectual property and acceptable use

    All content included on the App, unless uploaded by users, is the property of Housing Perks, our affiliates or other relevant third parties. Content includes text, graphics, images, audio, video, software, data compilations, page layout, underlying code and any other information stored on or forming part of the App.

    Usage

    For your own personal, non-commercial use, you may retrieve, display and view the content on a computer screen, or print one copy.

    Content

    You must not otherwise reproduce, modify, copy, distribute or use any content for commercial purposes without written permission from Housing Perks.

    Prohibited use

    You may not use the App in a way that causes damage or interferes with another person’s use; is harmful, unlawful, illegal, abusive, harassing, threatening or otherwise objectionable; or makes, transmits or stores electronic copies of copyright-protected content without the owner’s permission.

    Links to other websites

    The App may contain links to other sites. Unless expressly stated, these sites are not under the control of Housing Perks or our affiliates.

    Third-party content

    We assume no responsibility for the content of third-party sites and disclaim liability for loss or damage arising from their use.

    No endorsement

    Including a link on the App does not imply endorsement of the linked site or those in control of it.

    Availability

    Online facilities, tools, services and information are provided “as is” and “as available”. To the maximum extent permitted by law, we make no warranties of fitness for purpose, accuracy, compatibility or satisfactory quality, and are under no obligation to update information on the App.

    Security

    Although Housing Perks uses reasonable endeavours to keep the App secure and free from errors, viruses and malware, we give no warranty in that regard. Users are responsible for the security of their details and devices.

    Disruption

    Housing Perks accepts no liability for disruption or non-availability of the App.

    Changes to the App

    Housing Perks may alter, suspend or discontinue any part of the App, including products or services. These terms continue to apply to a modified version unless expressly stated otherwise.

    Liability that cannot be excluded

    Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability that cannot lawfully be limited or excluded.

    Events outside our control

    We will not be liable for losses arising from events beyond our reasonable control.

    Limitation of liability

    To the maximum extent permitted by law, Housing Perks accepts no liability for business losses; loss or corruption of data, databases or software; or special, indirect or consequential loss or damage.

    Transfer of rights

    You may not transfer your rights under these terms to another person. We may transfer ours where we reasonably believe your rights will not be affected.

    Changes to these terms

    We may vary these terms from time to time. Revised terms apply from publication, so users should check this page regularly.

    Entire agreement

    These terms contain the whole agreement between the parties relating to their subject matter and supersede prior discussions, arrangements or agreements.

    Third-party rights

    The Contracts (Rights of Third Parties) Act 1999 does not apply and no third party may enforce or rely on these terms.

    Severability

    If a court or competent authority finds any provision invalid, illegal or unenforceable, that part will be deemed deleted to the extent required. The remaining provisions will continue in effect.

    No waiver

    Unless otherwise agreed, a delay, act or omission in exercising a right or remedy will not be deemed a waiver of that or any other right or remedy.

    Governing law

    This agreement is governed by the law of England and Wales. Disputes, including non-contractual disputes or claims, are subject to the exclusive jurisdiction of the English and Welsh courts.

02 — Offers and rewards

Discounts, vouchers and cashback

App use

The App helps users receive discounts, cashback and free items from participating retailers. It is free to download, though we reserve the right to charge for future services. By using the App, you consent to Housing Perks offering services to you.

Discounts

Participating retailers set discounts and may change products or availability. Retailers may pause or stop voucher programmes, including while upgrading their systems. Housing Perks cannot be held responsible for these changes.

Liability

Housing Perks is not responsible for products or services supplied by retailers. Contact the retailer directly about its products, services, gift cards, restrictions or changes.

Limitations

Do not share your login details. You may not publish or share information about discounts or brands available through Housing Perks without written approval from Housing Perks and its parent company.

Security and responsibility

You are responsible for keeping your App, login details, identification and credentials secure. Housing Perks is not responsible for fraud resulting from your action or inaction, or for loss of data, funds or property arising from use of the service, to the extent permitted by law.

Termination

Housing Perks may terminate access to the App or another Housing Perks channel at any time and for any reason. On termination, you must delete the App from your device.

Amendments

Housing Perks and its parent company may amend these terms without notice. Continued use after an amendment means you accept the updated terms.

Governing law

These terms are governed by the laws of England and Wales. Disputes are subject to the non-exclusive jurisdiction of the courts of England and Wales.

03 — Support

Returns policy

Gift cards are non-refundable.

We can only consider a return, refund or reissue where required by law or where a proven fault or damage resulted from the production or issuing process. If any value has been spent, we cannot process a return or refund unless required by law.

04 — Troubleshooting

My gift card isn’t working

Shopping online

  1. Check that you are entering the card in the correct payment field.
  2. Check the balance using the retailer’s official website. Never enter card details on an unfamiliar site.
  3. Re-enter the details carefully, then contact the retailer’s customer service team if needed.

Shopping in store

  1. Turn your screen to full brightness. Ask the cashier to enter the long number and PIN manually if the barcode will not scan.
  2. Try a printed copy and ensure the cashier selects “gift card”, not “voucher code”.
  3. Check the balance and ask whether the retailer’s gift card system is working.
  4. Record the store and time, then contact the retailer’s customer service team.

Faulty gift cards

If a gift card appears faulty, do not complete the intended purchase using another payment method on the assumption that a refund will be available. Follow the checks above first. Retailer systems may take up to 48 hours to activate a card.

Contact Housing Perks support within one day of purchase with screenshots of errors, details of when and where the card failed, proof of purchase and as much supporting evidence as possible. Housing Perks may refuse a refund or reissue where this process has not been followed or evidence has not been provided, and may ask you to identify yourself where fraudulent activity is suspected.

Housing Perks is not responsible for refunding the purchase price of, or accepting the return of, products bought from retailers.
